This facility is the Moxie website and you have the ability to enter into transactions directly with Millie & More Pty Ltd, owner of the Moxie website, and/or certain parties whose content appears on the site. You acknowledge that third parties provide some of the material accessible through the facility, and Millie & More is not responsible for this material.

Agreeing to these terms and conditions also includes agreeing to the 'Specific Terms & Conditions' applied by Millie & More. These 'Specific Terms & Conditions' can be found below.

GENERAL PROVISIONS:

This agreement is governed by the laws in force in Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the Courts of Victoria and Courts of Appeal from them and/or any relevant tribunals for determining any dispute concerning this agreement. Millie & More may legally assign any of its rights and obligations under this agreement at any time, and if we do so these terms and conditions will be updated to reflect the assignment. Your use of this website and on-line facilities such as enquires or requests are subject to these terms and conditions. Your use of the website or any of its content signifies your acceptance of these terms and conditions.

1. Ownership, Copyright and Trade Marks:

All title, ownership rights and intellectual property (IP) rights, including copyright, rest with Millie & More, and any un-authorised use is strictly prohibited.

You acknowledge that copyright subsists in all software, including HTML code, provided on, by or in association with the website. You must not modify, copy, transmit, display, perform, publish, license or create derivative works from any information or software accessed by means of the website without the express permission of Millie & More. Where copying or transmission is expressly permitted, you must not change or delete any author attribution or copyright notice.

2. Accuracy of Information and Limitation of Liability:

Millie & More does not endorse or recommend any particular third party represented on this website. Millie & More has taken steps to ensure that the content of this website, including all information and listings is correct, but it is subject to amendment at any time without notice. As a user, you acknowledge and accept that: Millie & More cannot verify the accuracy, completeness or suitability for any particular purpose of (and has not done so), any information or content that is provided by third parties. That information or content may include errors, omissions or other inaccuracies. To the extent permitted by law, Millie & More will not be responsible for any errors, omissions or misleading information. You agree to make your own evaluation of the suitability, accuracy and completeness of any information, opinion, advice or other content that is available on or through the website before you rely upon it. You are solely responsible for the suitability of any third party service. In particular, Millie & More is not liable for any loss, damage, inconvenience or liability that is caused or incurred as a result of your use of any such services whether alone, or in association with other services. To the maximum extent permitted by law, Millie & More disclaims all liability for any technical errors, corruption of any data, un-authorised access to your personal data, inaccuracies in information supplied by third parties where that failure is due to circumstances beyond its control.

To the maximum extent permitted by law, Millie & More disclaims any warranties, assurances or promises, express or implied, regarding this website and any service or facilities that it provides.

4. Use of the 'online' or 'e-store' facility:

Millie & More accordingly accepts no responsibility or liability for any misunderstanding, error, loss, damage, or inconvenience whatsoever and howsoever caused in respect of any inquiry and/or request made through the on-line facility. You agree that you will carefully check, and correct any mistakes in, any inquiry and/or request that you make through the online facility.

5. Use of Your Contact Information:

As the user of this website and any Millie & More service or facility, you agree and consent that Millie & More may use your contact information in accordance with Millie & More's Privacy Policy. If you have any  questions about our Privacy Poilcy  or should you not wish to be contacted in the future, please notify Millie & More at info@moxie.com.au .

6. Indemnity:

As a condition of your use of this website you agree to indemnify Millie & More from and against any liability, damage or loss that Millie & More incurs or suffers as a result of any breach of these terms and condtions.

7. Your Responsibility:

By making a request through the website, you warrant to Millie & More that you are at least eighteen (18) years or older, or if you are aged under 18, that you have the consent of a parent or guardian to use and/or visit the website. You must read the specific terms and conditions and convey all information set out in those terms and conditions to Millie & More and any other parties covered by any request you make.

You must not use the service for any activities, that breach any laws, infringe any party's rights, or breach any standards, content requirements or codes promulgated by any relevant authority. You must not use the service in any way, which interferes with other users or defames, harasses or menaces anyone. You indemnify Millie & More from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to use of the service by you or any other person including using a membership identification or password you may subsequently receive.

 

SPECIFIC TERMS AND CONDITIONS

1. Fees, Charges or Services:

All transactions are processed in AUD (Australian Dollars) if shopping within Australia. If you are shopping from outside of Australia, you may opt to view the e-store in a different currency - your order will also be processed in your chosen currency. Certain charges, fees and/or services displayed on the website may, or may not include Australian Goods and Services Taxes (GST), depending on whether or not these items do or don't incur GST* and/or any additional charges that are applicable. These will be displayed either on the product listing, at the checkout, or advised to the purchaser upon action of the purchaser's request. Enquiries made through the website also constitute a request, and the correctness of this request in regard to abiding by the rules and regulations of Millie & More is the responsibility of the enquirer. Millie & More does not guarantee fees or charges quoted until the request is acted upon by Millie & More. You are hereby advised: Millie & More reserves the right to alter, change, delete or amend charges, fees and/or services without notice.

* Period products, like pads, tampons, liners and period cups are GST exempt within Australia as of January 1st 2019. Period boxes and kits containing GST-applicable items are charged a GST amount proportionate to the quantity of GST-applicable goods in each box/kit.

2. Credit Card Transactions:

If applicable, credit card transactions may incur service fees on certain services. If so charges will be advised to the purchaser. Millie & More accepts no responsibility for any breaches of security or misrepresentation in relation to credit card transactions.

3. Liability:

Millie & More makes no representations about the suitability, reliability, availability, timeliness, and accuracy of the content, software, products or services contained on or available through the website for any purposes. The data, software, products and services shown are provided in good faith and 'as is' without warranty or condition of any kind. Millie & More disclaims all warranties and conditions with regard to the accuracy, completeness, or fitness for a particular purpose of any data or services provided, whether express or implied. To the maximum extent permitted by any law, in no event shall Millie & More be liable to you for any direct, indirect, special, punitive, or consequential damages whatsoever resulting from any injury, loss, claim, damage or any incidental or consequential damages, including but not limited to lost profits or savings, arising out of or in any way connected with the use of any content, software, products or services contained on or available through the website.

Nothing in these terms and conditions excludes, restricts or modifies any condition or warranty which may at any time be implied by applicable laws including the statutory consumer guarantees as provided in the Competition & Consumer Act 2010 (Cth) except where it is legally permitted to do so. If Millie & More should be liable for the breach of a term implied by law, and it is legally permitted to do so, its liability will be limited at the option of Millie & More, to: (i) in the case of services supplied by Millie & More - the re-supply of the services or payment of the cost of doing this; or (ii) in the case of goods supplied by Millie & More – repair or replacement of the goods, supply of equivalent goods, or payment of the cost of doing this.

4. Cancellation Fees, Charges and/or Refunds:

Certain charges and/or fees may be payable in respect of transactions made on Millie & More's website. These transactions may include cancellation fees or any applicable charges imposed under the Millie & More refund policy. Before entering into a transaction, the onus is on the purchaser to check carefully whether any cancellation fee or charges applies, and/the purchaser is bound by the Millie & More refund policy. The purchaser is hereby advised: Millie & More reserves the right to amend any applicable cancellation fees, charges and/or the refund policy without notice.

5. Changes to These Terms and Conditions:

Millie & More reserves the right to change or modify all or any part of these terms and conditions at any time and without notice. Any changes to these terms and conditions will apply from the date they are published on the website. It is your responsibility to review these terms and conditions for any changes. 

6. Millie & More / Moxie e-store / Moxie Box Club Online Shopping Terms

The Agreement

By completing the purchase process and once Millie & More accepts an order, you acknowledge that you are entering an agreement between you as the purchaser and Millie & More. Each accepted order is a separate agreement under these terms and conditins and the Privacy Policy. If you do not agree to any of these terms and conditions, or you are not satisfied with the Privacy Policy, please do not make a purchase from Millie & More.

When purchasing from Millie & More, your financial details are not stored or held by Millie & More, in accordance with the Privacy Policy. If you have any questions regarding Millie & More's security policy, please contact us at info@moxie.com.au .

Orders (one-time purchases)

You place an order with Millie & More by selecting products and pressing the "Proceed to Checkout" button on the shopping cart page. Millie & More reserves the right to accept or reject an order for any reason including without limitation, unavailability of product; an error in the price, image or the product description; or error in your order. Orders are deemed received by Millie & More at the time of successful transmission of the order, and you will thereafter be unable to cancel the order. Orders are deemed accepted by Millie & More upon Millie & More acknowledging such order or failing to reject such order within 14 days. Millie & More currently accepts orders and ships worldwide. Shipping rates will be calculated at checkout. If you are shopping outside of Australia, please note that you may be required to pay duties and taxes on your order, as determined by your local customs authority. Any such fees or additional charges are to be paid by the customer. We recommend getting in touch with your local customs office for further info.

Recurring Orders – Subscriptions

Millie & More will automatically renew your subscription every 1, 2 or 3 months from the first date of purchase (depending on your selected frequency), as authorised by you during the sign up process, with the contents as selected by you. Millie & More will charge your credit/debit card account with the applicable subscription fee as per the subscription you have chosen to purchase. Shipping and GST (if applicable) will be included in your subscription fee payments as displayed at checkout, where applicable. Please note that if you have multiple subscriptions under the one account/email address, shipping will be charged separately, as these are treated as separate orders. You can cancel or update your subscription (including your delivery and therefore your billing frequency) any time, simply by logging into your account and updating your preferences. 

Cancelling Your Subscription

You may cancel your subscription at any time by logging on to your account at https://moxie.com.au/account/login To cancel a subscription, please login to your account on the website and select the "Manage my Subscriptions" link, then follow instructions towards cancellation (please note that you can also pause your subscription without charge or 'skip' upcoming months instead, if you wish). If you have any problems, please email orders@moxie.com.au . Cancellation of your subscription will take effect immediately and you will not receive any boxes you are yet to be billed for (if your most recent box has been billed, you will receive one last box). 

Product Availability

Millie & More uses its best endeavors to ensure products you have ordered are available for delivery and in most cases we will notify you the purchaser where a product is unavailable prior to you completing your order. For orders that are shipped via 'same day express shipping', Millie & More may, at its discretion, replace any unavailable product with a product it deems to be equivalent - either way, Millie & More will notify you of the change but will likely ship your order with the replacement item in the spirit of getting your order to you on time. However, the purchaser acknowledges that in some cases this is not possible and Millie & More may need to reject an order you have placed for a product where Millie & More establishes that it is unavailable for delivery. In such cases, Millie & More will refund in full all amounts the purchaser paid in respect of such unavailable product. Millie & More, where permitted by law, reserves the right to limit the sale of products to reasonable or normal household quantities.

If an individual product or item that is part of a Moxie Box Club Box or Kit (including ‘Welcome to Periods!’ Starter kits) is not available at the time of purchase, it will be replaced with an equivalent item (either, for example, the same product type in a different design, or, a product that is of the same or greater value than that which is out of stock) at Millie & More’s discretion.

Variation of Products and Price

Millie & More may vary the prices on this website at any time, and prices are subject to change until the purchaser has paid for the products in full. Product availability and product prices may vary between Millie & More's retail partners and those found on this website. All prices shown are inclusive of GST, where applicable by law, except for menstrual products, which are exempt from GST in Australia as of January 1st 2019. If you are shopping outside of Australia, please note that you may be required to pay duties and taxes on your order, as determined by your local customs authority. Any such fees or additional charges are to be paid by the customer. We recommend getting in touch with your local customs office for further info.

E-store discount codes

Millie & More may, from time to time, provide discount codes for use on the e-store on eligible items. Discount codes must be entered at the checkout for the discount to be applicable on that particular item/order. Some discount codes may not be eligible on all products on the Moxie e-store, or some inclusions may apply - for example, discount codes are not eligible on sale items and already reduced items. Only one discount code can be used at a time/per order. Please note we cannot add discount on items once checkout has been completed, or on previous purchases outside of the discount period.

Delivery & Postage Charges

For AU and NZ orders, Millie & More will deliver via Australia Post or any other postal carrier as deemed appropriate in its sole discretion. For international orders, the purchaser will be able to select a preferred carrier and/or shipping method at the checkout. These options may be subject to change at Millie & More's sole discretion. Shipping costs are included within the final price calculated and is payable by the purchaser at checkout. See the Shipping & Delivery page for more information on shipping rates and timings.

Returned/rejected parcels

For AU & NZ orders, please note that for any orders returned to Millie & More due to any details (such as your address) being input incorrectly at checkout at the time of order, or, if your parcel has not been collected by you and therefore returned to Millie & More, you will be automaticallyrefunded for your order, less the original shipping cost, and less an additional $11.21 return fee (as charged by Australia Post). Shipments that are rejected by the recipient may result in the customer incurring the return fee.

For all international orders, any goods that are returned to Millie & More or rejected by the recipient may result in the customer incurring a redirection fee, as charged by Australia Post (please note this will vary depending on your location). If you would like your parcel re-delivered to you, you will be liable for the shipping costs for the re-delivery. If you do not want your order re-delivered, your order will be refunded, less any original shipping fees and return parcel fees.

Customer Service Policy

Millie & More is committed to providing exceptional customer service and quality products. Millie & More endeavours to make sure that all products listed on its website are currently in stock and pricing is true and correct. Standard delivery time-frames are between 2 - 14 business days (dependent on stock availability, packing lead-times l, delivery method selected by the purchaser and delivery location). In the event that an ordered item is not available or Millie & More is unable to fulfill your order, Millie & More will notify you within two (2) business days to arrange an agreeable alternative item, advise of a product alternative that has been provided, a back-order, or a refund where applicable by law. Returns

Millie & More will offer a refund/replacement/exchange on products if they are deemed faulty, damaged or if the incorrect product was delivered. In this case please email orders@moxie.com.au with your order number. For any incorrect items received, you must notify Millie & More within 14 days of receiving your parcel (as per postage carrier delivery date stamp). Due to the intimate nature of its products, Millie & More offers no facility for change of mind or for an incorrect purchase being made on a purchase made through this online store - please ensure you make the correct purchase and contact Millie & More prior to purchase if you have any questions. The refund of return postage costs will be assessed on a case-by-case basis and no further correspondence will be entered into.
